South Rim Spray Foam
Terms & Conditions
TERMS AND CONDITIONS
Effective Date: September 16, 2026
These Terms and Conditions (“Terms”) govern use of southrimsprayfoam.com (the “Site”) and the purchase of services from South Rim Spray Foam LLC (“South Rim,” “we,” “us,” or “Contractor”).
- Services and Quotes
South Rim provides spray foam insulation, concrete lifting/polyjacking, and related services as specifically described in an approved written quote, proposal, invoice, or change order (collectively, the “Quote”).
Site content, preliminary pricing, and online requests are informational only and do not constitute a binding offer to perform work. A binding agreement is created only when Customer approves a Quote, and Contractor accepts it, or when Customer otherwise authorizes Contractor to begin work.
The Quote identifies the property, scope, price, payment schedule, exclusions, and any job-specific terms. If a Quote conflicts with these Terms, the Quote controls solely for that project.
2. Quote Validity, Scope, and Changes
Unless otherwise stated, Quotes are valid for thirty (30) days from the date issued.
Quotes are based on visible conditions and information available when prepared. Hidden, changed, or unforeseen conditions—including concealed utilities, voids, unsuitable substrate conditions, structural issues, water intrusion, inaccessible areas, additional material needs, or conditions that materially affect safety or scope—may require a written change order, revised price, or rescheduling.
3. Scheduling, Deposits, and Payment
Concrete lifting/polyjacking jobs do not require a deposit unless the approved Quote expressly states otherwise.
For spray foam insulation projects, a deposit may be required to reserve a service date, mobilize equipment, or order materials. Any required deposit, including a fifty percent (50%) deposit, will be clearly stated in the approved Quote.
Unless the Quote states otherwise, the full unpaid balance is due on the date the work is completed.
Customer may pay by check, credit card, ACH transfer, or cash. Contractor does not currently offer financing.
Any balance not paid when due is delinquent. Contractor may pursue lawful collection remedies, including reasonable collection costs and attorney fees where permitted by law. No separate late charge or interest rate will be assessed unless its amount, timing, and applicability are expressly stated in the approved Quote.
4. Cancellations and Refunds
Customer cancellation requests must be submitted in writing. Deposit refunds will be considered case by case based on the timing of cancellation, materials ordered, documented costs incurred, crew or equipment commitments, and work completed before cancellation.
Nothing in these Terms limits any cancellation or refund right that cannot legally be waived. Where a statutory cancellation notice is required, Contractor will provide that notice with the applicable Quote or contract.
Except as required by law or expressly stated in writing, completed services are non-refundable.
5. Customer Responsibilities and Job-Site Readiness
Customer must provide safe, timely, and unobstructed access to the work area, including reasonable access for personnel, vehicles, equipment, and materials. Customer must secure pets, remove or protect personal property, and keep children and unauthorized persons away from the work area.
Unless otherwise stated in writing, Customer is responsible for providing adequate access to power, water, lighting, and other site utilities reasonably required for the work.
Customer must disclose known site conditions that may affect the work, including underground or concealed utilities, private electrical lines, irrigation, septic systems, plumbing, drains, radiant heating, structural conditions, hazardous materials, prior repairs, and access limitations.
If the site is unsafe, inaccessible, unprepared, or materially different from the conditions represented, Contractor may delay, reschedule, or decline the work. If Contractor arrives at the scheduled time and cannot perform work for one of these reasons, Contractor may charge a $250 trip fee.
6. Spray Foam Insulation Services
For spray foam work, Customer must ensure that the work area is cleared of debris, furnishings, and personal property before Contractor arrives. Customer is responsible for protecting items left in or near the work area.
Customer must comply with Contractor’s reasonable instructions regarding site temperature, moisture, ventilation, occupancy, access restrictions, and re-entry. Contractor is not responsible for concealed conditions within walls, ceilings, crawl spaces, attics, or other inaccessible areas, including undisclosed wiring, plumbing, moisture intrusion, mold, rot, pests, structural defects, or previous damage.
7. Concrete Lifting / Polyjacking Services
Concrete lifting is intended to improve the elevation, stability, and drainage of the specific concrete areas identified in the Quote. Contractor will use reasonable professional judgment in determining injection locations, lift sequence, and the extent of lift that can be performed safely.
Concrete lifting does not constitute structural engineering, foundation repair, drainage design, concrete replacement, crack repair, caulking, landscaping, excavation, utility relocation, or correction of conditions outside the approved scope unless expressly included in the Quote.
Customer acknowledges that existing concrete may be cracked, deteriorated, poorly supported, structurally connected, or otherwise unsuitable for lifting. Controlled lifting may reveal, widen, or cause cracks, movement, cosmetic changes, or damage associated with pre-existing conditions, unstable concrete, inadequate reinforcement, hidden voids, or subsurface conditions.
Contractor does not guarantee elimination of all trip hazards, restoration of original appearance, exact matching of elevations, correction of drainage throughout the property, or prevention of future settlement, heaving, cracking, or unevenness. Concrete may move after completion because of soil movement, erosion, drainage conditions, tree roots, freeze-thaw cycles, vehicle loads, geological activity, or other conditions beyond Contractor’s control.
8. Warranty
Contractor does not offer an express warranty for concrete lifting or polyjacking work. Nothing in these Terms limits any legal right or remedy that cannot lawfully be waived.
9. Limitation of Liability
To the fullest extent permitted by law, Contractor is not responsible for losses, damages, or delays caused by pre-existing conditions, concealed conditions, inaccurate customer-provided information, unsafe or inaccessible work areas, weather, utility failures, third-party actions, or conditions beyond Contractor’s reasonable control.
10. Job Photos and Marketing Permission
Customer authorizes Contractor to photograph or video the work area before, during, and after the work for estimating, project documentation, quality control, and marketing purposes, including use on Contractor’s website, social-media accounts, advertisements, and printed materials.
Contractor will not intentionally publish Customer’s name, street address, phone number, or other personally identifying information without separate written permission.
11. Governing Law and Contact Information
These Terms and all project agreements are governed by the laws of the State of Idaho. If any provision is found invalid or unenforceable, the remaining provisions remain in effect.
